Notes: In 2008 in New York state there were 64 individuals convicted following a hate crime arrest (the number used to calculate the percentage in the graph above), but only 10 of these individuals were charged with a hate crime. In 63 of the 64 cases the defendants avoided trial by pleading guilty. In 2008 in New York state there were 596 reported hate crime incidents and 159 hate crime arrests. The reported number of hate crimes by the New York Division of Criminal Justice Services do not match the number of New York hate crimes reported by the FBI
